Buying on South Padre Island: what to check before you make an offer

Island property comes with a few Texas-coast details that inland buyers rarely see. Here is the short list we review with every South Padre Island buyer.

South Padre Island sits in Cameron County, one of the 14 first-tier coastal counties where the State of Texas has special rules for wind and hail insurance. That affects what you pay to insure a condo or beach house, which in turn affects your monthly cost and, if you plan to rent the property, your returns. None of it is a reason to skip the island. It is a reason to ask the right questions during your option period.

1. Ask for the windstorm Certificate of Compliance

Coastal homes that get wind and hail coverage through the Texas Windstorm Insurance Association (TWIA) generally need a Certificate of Compliance showing the structure, and any later repairs or additions, met the windstorm building code. The Texas Department of Insurance (TDI) issues these as a WPI-8 (work inspected while underway) or WPI-8-E (completed work). Between January 2017 and May 2020, TWIA itself issued WPI-8-C certificates.

  • Request copies from the seller and verify them in TDI's online windstorm lookup.
  • Re-roofs, replaced windows and doors, decks and additions can each need their own certificate. Match the certificates to the work the seller disclosed.
  • Older buildings: TWIA notes that structures built or altered on or after January 1, 1988 need certification, with limited exceptions.
Why it matters: TWIA says a property without the required certificate may be considered uninsurable and ineligible for its coverage, which can make financing harder.

2. Price the insurance stack before you write the offer

On the coast, insurance is often three policies, not one: a homeowners or condo policy that excludes wind, a TWIA (or private) wind and hail policy, and flood insurance. TWIA is the insurer of last resort. To qualify, an applicant generally must have been declined by at least one private insurer writing wind coverage in the area, and the property must be in insurable condition.

Get a written quote from a licensed Texas insurance agent who writes TWIA policies. For condos, also ask the association for its master policy summary so you know which parts of the building it covers and what your unit owner policy must cover.

3. Check the flood zone

Look up the property on FEMA's flood maps. TWIA requires proof of flood insurance for some properties in zones V, VE and V1-30 that were built, altered, remodeled or enlarged on or after September 1, 2009. Your lender may also require flood coverage in higher-risk zones.

4. Planning to rent it out? Read the city's short-term rental rules

The City of South Padre Island regulates short-term rentals, meaning stays of fewer than 30 consecutive days. According to the city:

  • Each rental unit needs a city short-term rental license, and the license number must appear in every advertisement.
  • Owners must designate a local contact who is available around the clock.
  • Hotel Occupancy Tax is due monthly. The city rate is 10.5%, plus a 0.5% Cameron County venue tax and the separate 6% State of Texas rate.

Rules change, and condo associations can add their own rental restrictions. Ask the association for its current declaration, rules and rental policy before your option period ends.

5. Review the association documents carefully

Frequently asked questions

Does every South Padre Island property need a WPI-8?

Not every one, but TWIA generally requires a Certificate of Compliance for structures built, altered, repaired or added to on or after January 1, 1988, with limited exceptions. Check the certificates on file with the Texas Department of Insurance before you buy.

Can I rent my South Padre Island condo on a nightly basis?

Stays under 30 days require a City of South Padre Island short-term rental license, a 24/7 local contact and monthly Hotel Occupancy Tax filings. Your condo association may have additional restrictions, so review its rules before you buy.

Is flood insurance required on South Padre Island?

It depends on the flood zone, your lender and your wind policy. TWIA requires proof of flood insurance for certain properties in zones V, VE and V1-30 built or altered on or after September 1, 2009.
